This Privacy, Terms & Conditions Policy explains how Heritage Productions collects, uses, stores and protects personal information, and sets out the terms that apply when you use this website or place an order with us.

Heritage Productions is a Christchurch-based photography business providing school, group and event photography services. By using this website, accessing a gallery, creating an account, placing an order, downloading images or contacting us, you agree to the terms set out below.

1. Our services

Heritage Productions photographs schools, groups and events. For school photography, photo days are usually arranged with the school. Depending on the service requested by the school, this may include individual portraits, sibling photos, class photos, group photos, staff photos and other school-related photography.

Where a school has arranged a photo day, students who are present may be photographed as part of that service unless the school, parent, caregiver or authorised representative has told us otherwise through the relevant school process.

Order cards, access codes, QR codes, passcodes or gallery links may be provided so that parents, caregivers, students, schools or authorised users can view and order the relevant images.

2. Privacy policy

2.1 Personal information we collect

We collect personal information only where it is reasonably necessary for our photography services, order processing, customer support, account management, payment processing, delivery, communication, security or legal obligations.

Depending on how you interact with us, we may collect:

  • your name, email address, phone number, billing address and delivery address;
  • student name, school, year level, class, room, group or other photo-day information;
  • school staff names or school contact details where relevant to a photo day or order;
  • order details, product selections, order history, payment status and delivery details;
  • photographs, image selections, download records and related gallery information;
  • messages, support requests, correction requests, refund requests or other communications with us;
  • account login details, access code use, session details and security records;
  • IP address, browser type, device information, operating system and website activity data; and
  • marketing preferences, such as whether you have signed up to receive email updates or promotions.

2.2 Information provided by schools or organisations

In many cases, we receive information from a school or organisation rather than directly from the person the information relates to. This may include student names, class lists, year levels, group information, photo schedules, staff details, school contact details or instructions about students who should not be photographed or whose images should not be made available.

We use this information to organise photo days, match images to the correct students or groups, produce order cards or access codes, process orders, distribute products and resolve any photo-day or order issues.

Where required, we take reasonable steps, including working with schools and organisations, to ensure people are informed about the collection and use of their personal information.

2.3 Student images and privacy

Images of students and young people are treated with care. A photograph or related gallery record can be personal information where it identifies a person.

We use student and school images only for the purpose for which they were collected, such as providing photography services to the school, making images available to authorised viewers, producing ordered products, correcting image or name issues, providing customer support and maintaining appropriate business records.

We do not use student images for Heritage Productions advertising, website content, social media or promotional material unless we have appropriate permission or authority to do so.

If you believe you have accessed the wrong student’s image, or if a gallery, passcode or order card shows an image that should not be available to you, please contact us immediately so we can investigate and restrict access if required.

2.4 How we use personal information

We may use personal information to:

  • provide school, group and event photography services;
  • create, manage and secure galleries, accounts, QR codes, passcodes and order access;
  • match photographs with the correct student, class, group, school or order;
  • process, print, package, deliver and support orders;
  • process payments and confirm payment status;
  • communicate with you about an order, account, correction request, refund request or support issue;
  • send service-related emails, such as order confirmations and download links;
  • send marketing or promotional emails where you have agreed to receive them or where the law allows us to do so;
  • improve our website, services, security and customer experience;
  • prevent fraud, misuse, unauthorised access or technical issues; and
  • meet our legal, accounting, tax, record-keeping and business obligations.

2.5 Marketing emails

If you sign up for email promotions or updates, we may send you information about Heritage Productions products, services or offers. You can unsubscribe from marketing emails at any time by using the unsubscribe option in the email or by contacting us.

We will still send service-related messages where necessary, such as order confirmations, download links, account messages or support replies.

2.6 Who we share information with

We do not sell personal information.

We may share personal information where reasonably necessary with:

  • the relevant school or organisation, where needed to arrange photo day, distribute school-delivered orders, correct student or group details, or resolve an order issue;
  • Stripe, banks and payment-related service providers to securely process payments;
  • printing, production, packaging, courier, postage or delivery providers;
  • website hosting, email, IT, security, storage, software or support providers;
  • professional advisers, such as accountants, insurers or legal advisers;
  • government, regulatory, law enforcement or dispute-resolution bodies where required or permitted by law; and
  • another party with your permission, or where disclosure is otherwise allowed under the Privacy Act 2020.

2.7 Overseas processing or storage

Some of our service providers may process or store information outside New Zealand. Where we disclose personal information overseas, we will take reasonable steps required under New Zealand privacy law to ensure the information is appropriately protected, or we will rely on another lawful basis for that disclosure.

2.8 Payment information

Online payments are processed securely through Stripe. When you enter card details during checkout, those details are processed by Stripe.

Heritage Productions does not store your full card number or card security code. We may receive and store limited payment-related information, such as payment confirmation, transaction reference, payment status, order total, billing details and limited card information such as card type or last four digits where supplied by Stripe.

2.9 Security

We take reasonable steps to protect personal information from loss, unauthorised access, misuse, disclosure, alteration or destruction. These steps may include password-protected systems, access controls, secure payment processing, encryption in transit, restricted staff access, backups and website security measures.

No website, email system or online service can be guaranteed to be completely secure. If you believe your account, access code, passcode or personal information has been misused, please contact us immediately.

2.10 Privacy breaches

If we become aware of a privacy breach, we will assess it and take appropriate steps to contain, investigate and respond to it. If a breach has caused, or is likely to cause, serious harm, we will notify the Office of the Privacy Commissioner and affected individuals where required by law.

2.11 Accessing or correcting your information

You may ask us to access or correct personal information we hold about you. We may need to verify your identity and, where the request relates to a student or another person, confirm that you have authority to make the request.

If you have an online account, you may be able to update some account information by logging in and using the account area. For other requests, please contact us at support@heritageproductions.co.nz.

2.12 Deleting or removing information

You may ask us to remove or delete personal information. We will consider each request and take reasonable steps where we are able to do so. In some cases, we may need to retain certain information for order history, customer support, accounting, tax, legal, dispute-resolution, security, archive or backup purposes.

2.13 Retention

We keep personal information only for as long as it is reasonably required for the purposes for which it may lawfully be used.

School and event photography archives may be kept long-term, generally for 30 years or longer, so that families, schools and authorised customers can request reprints, replacements, downloads, historical orders or support with past photo records.

We may also retain order records, customer support records, payment records, tax records and related business records for as long as needed for accounting, legal, tax, dispute-resolution, customer service and business administration purposes.

When information is no longer required, we will take reasonable steps to delete it, de-identify it or securely archive it.

3. Cookies and website technology

Cookies and similar technologies help the website function properly, keep you logged in, remember cart contents, support security and improve the customer experience.

Some cookies are necessary for the website to work. You can adjust cookie settings in your browser, but blocking necessary cookies may prevent parts of the website from working correctly.

4. Access codes, passcodes and account security

Some galleries or photo records are accessed using order cards, QR codes, passcodes, passwords or account logins. These access details are intended only for authorised users.

You are responsible for keeping access codes, passcodes and login details secure. Please do not share them publicly or with anyone who should not have access to the relevant images.

We may disable, restrict or update access to a gallery, account, image or order if we believe there has been unauthorised access, incorrect access, misuse, a privacy concern or a technical issue.

5. Orders, prices and payment terms

All orders are subject to acceptance by Heritage Productions. When you place an order, you are responsible for checking that the product, image, quantity, delivery option, name, email address and delivery details are correct before payment is completed.

Prices are shown on the website at the time of ordering and are GST inclusive unless clearly stated otherwise. Delivery fees, where applicable, will be shown during checkout. Prices may change from time to time, but confirmed orders will be processed at the price shown at checkout unless there has been an obvious error.

If there is an error with pricing, product availability, product description, image access or order details, we may contact you to correct the issue, cancel the affected part of the order, provide a replacement option or issue a refund where appropriate.

6. Shipping and delivery

Delivery options may vary depending on the school, event, product and order date.

6.1 Free bulk shipping to school

Where free bulk shipping is available, your order must be placed before the deadline stated on the order card, email, gallery or website. Orders placed within the free bulk shipping period are usually delivered to the school after the bulk order period closes.

6.2 Late orders and direct shipping

Orders placed after the free bulk shipping deadline may be sent directly to the delivery address supplied at checkout, and a delivery fee may apply.

6.3 Delivery timeframes

Delivery timeframes are estimates only. We aim to process, print and dispatch orders as promptly as possible, but delivery may be affected by school schedules, production timing, public holidays, postal or courier delays, incorrect delivery information, weather events or other circumstances outside our control.

If your order has not arrived within a reasonable time, please contact us with your order number so we can investigate.

7. Returns, reprints and refunds

We take pride in providing high-quality photography products and will work with you to resolve genuine problems fairly.

Nothing in this policy limits your rights under the Consumer Guarantees Act 1993, Fair Trading Act 1986 or any other law that applies in New Zealand.

7.1 When we will help

Please contact us if:

  • your printed product arrives damaged;
  • you receive the wrong product, size or image;
  • there is a printing, production or quality issue caused by us;
  • a digital download is faulty, inaccessible or not supplied as described;
  • your order has not arrived within a reasonable time; or
  • there is another issue with your order that you would like us to review.

Depending on the issue, we may provide a correction, reprint, replacement, download reissue, refund or another suitable remedy.

7.2 How to request help

Please contact support@heritageproductions.co.nz or phone 03 365 3554. Include your order number, the student or gallery name if relevant, a description of the issue and any supporting photos showing the problem.

Please contact us as soon as possible after noticing an issue, preferably within 7 days of receiving your order. This helps us investigate and resolve the issue quickly. This timeframe does not limit any rights you may have under New Zealand law.

7.3 Change of mind

Because many of our products are printed, custom-produced or supplied digitally for a specific order, we do not usually provide refunds for change of mind, incorrect selections made by the customer, or duplicate orders placed by mistake.

We may choose to help at our discretion where production has not started, but we are not required to provide a refund or exchange simply because you change your mind.

7.4 Custom products

Custom-made or personalised products, including printed photographs, packages, edited images and products created specifically for your order, cannot usually be returned unless they are faulty, incorrectly supplied, not as described, or there is another issue that gives you a remedy under New Zealand law.

7.5 Digital products

Digital downloads are usually non-refundable once supplied or accessed, unless the file is faulty, not as described, incorrectly supplied or you are otherwise entitled to a remedy under New Zealand law.

7.6 Refund method

Approved refunds will usually be made to the original payment method. Processing times may vary depending on Stripe and your bank.

8. Image use, copyright and personal use licence

Heritage Productions owns, controls, or is authorised to supply the images made available through this website, unless otherwise agreed in writing. Where a separate school, organisation or client agreement applies, that agreement may set out additional terms for image use, access or ownership.

When you purchase a print or digital image, you are buying that product and receiving a personal-use licence. This means you may use the purchased image for personal, domestic and non-commercial purposes.

Purchased digital images may be downloaded, saved, printed for personal use, and shared with family and friends. You may also share purchased individual or family images on your personal social media pages, provided the image is not used for commercial, advertising, fundraising, political, harmful, misleading or unlawful purposes.

You must not sell, licence, commercially reproduce, commercially distribute, use for advertising, use for AI training, use for facial recognition, enter into competitions for commercial gain, or otherwise exploit purchased images without written permission from Heritage Productions or the relevant rights holder.

Please take extra care with class, team, group and sibling images, as these may include other children or young people. Do not share group images publicly in a way that breaches another person’s privacy, safety, dignity, school rules or reasonable expectations.

Proof images, watermarked images, gallery previews, screenshots and images that have not been purchased must not be copied, downloaded, screen captured, altered, shared, published or used without permission.

9. Website use

You agree not to misuse this website, attempt to access galleries or accounts without authority, interfere with website security, scrape or copy content, upload harmful material, or use the website in a way that is unlawful or harmful to Heritage Productions, schools, students, families or other users.

We may suspend, restrict or remove access where we believe there has been misuse, unauthorised access, a privacy concern, a security issue or a breach of these terms.

10. Accuracy of information

We take reasonable care to keep website information, product descriptions, prices, names, order details and gallery access accurate. However, errors can occur.

If you notice incorrect information, the wrong student name, the wrong image, an incorrect class or group label, or any other issue, please contact us as soon as possible so we can review and correct it where appropriate.

11. Limitation of liability

To the extent permitted by law, Heritage Productions is not liable for indirect, incidental or consequential loss arising from use of this website, delays, service interruptions, incorrect information supplied by a customer or third party, postal or courier delays, unauthorised sharing of access codes, or events outside our reasonable control.

Nothing in these terms limits or excludes any rights, remedies or guarantees that cannot be limited or excluded under New Zealand law.

12. Links to other websites

This website may link to other websites, services or social media pages. We are not responsible for the content, security or privacy practices of websites we do not control. You should review the privacy policy and terms of any third-party website you visit.

13. Changes to this policy

We may update this Privacy, Terms & Conditions Policy from time to time. The latest version will be published on this page with the updated date.

14. New Zealand law

These terms are governed by the laws of New Zealand.
